Obtaining a police check

Good Fame and Character

AFS licensees have obligations relating to the competence, knowledge and skills of their responsible managers (RMs), as well as the officers’ “good fame and character”.

We have recently been asked how ASIC expects a licensee to comply with the obligation to test their responsible managers’ good fame and character.

Having reviewed the Licensing Kit and the Corporations Act we recommend that licensees ensure their RMs undertake an Australian Federal Police check annually or bi-annually to confirm their good character and to prove to ASIC compliance with the licence conditions and obligations.

How do you obtain a Police Check?

The Australian Federal Police provides criminal history checks for:

  • residents of the Australian Capital Territory (ACT), Jervis Bay Territory and other external Commonwealth territories;
  • people seeking employment with the Commonwealth Government;
  • people requiring a check under federal legislation, for example, aviation security, immigration purposes;
  • volunteers and charities (ACT only);
  • overseas employment;
  • adoption, including overseas adoption; and
  • visa applications.

Fees

Fees are current but are subject to change without notice. It costs $32.73 for each name check application, which is sufficient to comply with ASIC.

Processing Times

The current processing time for a routine national police check is approximately 15 working days from the date received by Criminal Records.

Please be aware that processing times for national police checks may vary as the AFP is reliant on other police jurisdictions for some information.
