NIBA Vic Public Liability Insurance Seminar – Subcontractors and vicarious liability with Proclaim
This breakfast seminar kindly hosted by Proclaim will look at public liability insurance and will focus on Subcontractors and vicarious liability .
Richard Thomas will be compering/moderating the event.
The speakers will be Ananya Tiwari and Tim Kasem, both members of the Public Liability Insurance team at Proclaim.
Anaya will be discussing the employer/employee relationship in light of the recent court case in the UK regarding whether Uber drivers are employees or subcontractors. She will also use a hypothetical to work through the multifactorial test used to determine whether someone is an employee or a subcontractor.
Tim will be discussing course of employment, explaining the manner in which and employees actions or negligence has the capability to directly affect their employers liability position on a claim.

About the speakers
Richard manages the Insurance division of Proclaim which provides outsourced claims solutions to various insurers including Lloyds of London. He has a wealth of experience managing liability claims for various affinity programs, including the sporting and hospitality sectors. Richard has presented to insurance and industry, conducted seminars on indemnity and claims issues delivered training and auditing services and hotel groups and clubs.
Ananya is a lawyer and insurance professional with expertise in various aspects of the insurance industry including claims management, arbitrations, compliance, contract review and drafting and fraud investigations. She has significant expertise managing complex, multi-party construction liability and general liability disputes from the lens of Lloyds of London underwriters. Prior to joining Proclaim, Ananya had experience working in the legal claims departments of a Manhattan insurance carrier, and a risk management firm working across the United States.
Prior to entering the world of insurance Tim undertook his studies in Law and Business at Victoria University. During his studies and shortly after graduating from university, Tim worked as clerk for Ryan Carlisle Thomas lawyers within the Workers' Compensation and Employment law division. After his admission into the legal profession in August 2012 Tim commenced his employment as a Liability Claims Administrator with Ansvar Insurance Limited and shortly after he was elevated to his previously held position as a Liability Claims Consultant. His experience includes handling a variety of liability claims including; general liability, employment practices, personal accident, professional indemnity, directors and officers and trustee liability claims. Tim is also on the claims faculty advisory Board and General Council - ANZIIF.
