NIBA Guidance: Changes to anti-hawking provisions in the Corporations Act

NIBA, in conjunction with Radford Lawyers, has developed the attached guidance on the changes to the anti-hawking provisions in the Corporation Act, which come into effect from Tuesday 5 October 2021.

Members are encouraged to read the attached guidance prior to Tuesday 5 October 2021 to understand the:
• changes to the anti-hawking provisions in the Corporations Act
• objectives of the prohibition for consumers
• rules that apply to the person who undertakes the prohibited activity
• various exemptions to the prohibition.

Members are encouraged to seek their own professional advice on the legal requirements that apply to them and their business and amend procedures and documentation as appropriate to their circumstances.
